Hereinafter, the SuperMole team will be referred to as "SuperMole", the "Site", the "Application", the "Game" or "we" (including "our"/our" and so on). And users of the Site and the Game/App will be referred to as "User" or "you" (including "you/your" and so on).

Briefly about the game/app

SuperMole is a multichain game in the P2E (Play-to-Earn) genre. Players take a character, Mole, and use him to "mine" in-game SuperMole tokens. The Game/App uses the Polygon blockchain, and other blockchains will be added in the future. The mechanism of game operation and in-game token accrual is based on an automatic smart contract in order to ensure transparency of the game process and its security from external interference, including changes in the established rules of the game. The game can be launched via the web version of the website, the App, Telegram messenger or other software solutions.

What are the "Terms, Conditions and Risks"

"Terms, Conditions and Risks" is an informational and legal agreement that SuperMole enters into with the User with respect to their access to and use of the https://supermole.io/ Site and the SuperMole Game/Application, and with respect to their access to and use of any other sites, applications, social networks and other web resources that are in any way affiliated with us.

You may only use our services if you have accepted the applicable Terms, Conditions and risks. In other words, by accessing and/or using the Site or Game/Application, you acknowledge that you have carefully and fully read this document, agree to the rules, regulations and prohibitions set forth herein and agree to abide by them. If, however, you do not agree in whole or in part with the Terms, Conditions and Risks, you must not use our services or visit or use the Site/Game/Application. SuperMole may, in its sole discretion, modify or amend the applicable Terms, Conditions and Risks at any time and for any reason. You for your part shall independently review the applicable Terms, Conditions and Risks for possible changes on a regular basis. You may use the date of the last update as a reference point for changes, which is set out at the bottom of this document. By using the Site and/or the Game/Application after this date, you confirm that you agree to be bound by all changes to the Terms, Conditions and Risks. If you wish, you may change your mind at any time and withdraw your consent to the current Terms, Conditions and Risks. In doing so, you will need to send a written notice to the e-mail address provided in the "Contact Us" section. Please note that if you withdraw your consent or cease to be bound by the applicable Terms, Conditions and Risks (in part or in full), you will not receive any feedback on any financial or other transactions that you may perform on the Site or in the Game/Application or using third-party specialized exchanges, exchangers, payment systems and other services. In such a case, you will not be allowed to use our services and your account in the Game may be blocked without the ability to perform any actions, including transactions with tokens.

Creating an account (registration)

To access certain features of the Game/Application, you will need to create an account (register). You will receive a secret mnemonic phrase, and you will be able to set/use a nickname and create a password. You must keep your mnemonic phrase, nickname and password secret - you are solely responsible for any unauthorized use of your account. For its part, SuperMole will not be liable for any loss you incur as a result of loss of access to your account and/or use of your account by third parties.

Rules and prohibitions on use

You may visit and use the Site and/or the Game/Application only if you comply with the rules listed below. The responsibility for their observance lies entirely and solely with you. In turn, SuperMole is not responsible for the User's violation of these rules.

You are prohibited from accessing and using the Site and/or the Game/Application if you are not of legal age (according to the laws of your country of residence or domicile) and are under 18 years of age. Therefore, by accessing and using the Site and/or the Game/Application, you automatically confirm that you are of legal age.

The Site and/or Game/App may not be distributed or used in all countries and jurisdictions - exceptions exist. These actions are prohibited if your use of the Site, the Game/Application and/or the distribution of any information about SuperMole does not comply in any way (directly or indirectly) with the laws of the countries, regulations or may result in certain registration requirements within such countries or jurisdictions. As a consequence, you unequivocally state that you are not a citizen or resident of a country, the laws of which in one way or another prohibit visiting and using web resources/games/applications of this orientation. Among other things, you explicitly state that you are not a citizen or resident:

Other countries where there are any prohibitions or restrictions, including indirect ones, at the legislative level on visiting and using web resources and games/applications of this orientation, i.e. interacting with blockchain technology in one way or another (hereinafter - “Prohibited Countries”).

Countries that are under any type of international sanctions, including those related to a ban on information of any kind.

Without exception, any person who is a citizen, tax resident or resident of the United States of America and/or other countries with any of the prohibitions listed above (“Prohibited Country”/“Prohibited Countries”) is prohibited from accessing and using the Site and/or the Game/Application and from disseminating any information about it in any way. In view of the above provisions, if you are a citizen, tax resident, temporary or permanent resident of the United States or other Prohibited Countries, you are strongly advised to exit the Site and/or the Game/Application immediately, not to use them thereafter, and not to disseminate any information about them, either personally or through any third party (intermediary). If you visit and/or use the Site or the Game/Application (or disseminate any information about it) contrary to the above prohibitions, you do so at your own discretion and, accordingly, you are solely responsible for your own failure to comply with local laws as they apply to you. We, for our part, strongly urge you to comply with all rules set out in these Terms, Conditions and Risks, as well as all international laws and the laws of your country of residence and/or domicile.

What is prohibited on the Site and in the Game/Application

You may use the Site or the Game/Application only for the purposes for which we have developed them. You may not use the Site or the Game/Application for any other purpose, including commercial purposes for your own benefit (regardless of the amount of that benefit). The only exception is if you have a legal agreement with SuperMole.

When using the Site and the Game/Application, among other things, the following activities are prohibited:

Using any type of content present on the Site or the Game/App to copy, create analogs, compilations or catalogs without our prior consent given to you in writing. Copying or adapting the software of the Site and Game/Application, including but not limited to HTML, JavaScript or other code.

Using the Site and the Game/Application in any unauthorized way, including collecting Users' personal data (names, email addresses, Telegram account names, and other information) through electronic or other data collection tools and conducting third-party mailings, including spam mailings, or creating User accounts by automated means or under false pretenses, among other things.

The use of robotic methods in any operations on the Site and in the Game/Application; use of the Site and the Game/Application for advertising purposes or creation of offers to sell various types of goods and services with their help.

Bypassing, disabling or otherwise interfering with the Site and Game/Application's security features, including features that prevent or restrict the use or copying of any content on the Site or Game/Application; improperly placing any links on the Site or Game/Application.

Intending to impersonate another User of the Site and Game/App or an official SuperMole representative; selling or transferring by any means your account to any third party (third party). Harassing, intimidating or threatening Users, employees, agents and other SuperMole representatives.

Misleading our support staff, including willfully providing untrue information about fraud, abuse or any other illegal activity; using any automated means of using the system, including software scripts to perform any transactions, including sending all types of messages, or using any type of data mining, robots or other similar tools, including data collection and extraction.

Interfering with the operation of the Site and the Game/Application with the intention of creating any kind of problems that could prevent their stable operation, or with the intention of partially or completely disabling them, including by creating an increased load on the Site and the Game/Application or on the servers operated by them, among other things.

Any insults, regardless of the subject matter, to other Users of the Site and the Game/Application or causing harm to Users in one form or another.

Using the Site and the Game/Application and/or the content posted thereon for any commercial enterprise with the intention of generating revenue or any other benefit.

Deciphering, decompiling, disassembling or reverse engineering any type of software incorporating or in any way forming part of the Site and Game/Application; intending to circumvent any of the Site and Game/Application's security mechanisms used to prevent or restrict access to the Site and Game/Application or any part thereof.

Removing copyright or other proprietary notices from any content on or derived from the Site or the Game/App.

Uploading or transmitting (or attempting to do so) any type of file virus or other malicious material that may interfere with the uninterrupted use of the Site and the Game/Application or result in the alteration, degradation, or disruption of any functions that enable the operation or maintenance of the Site and the Game/Application.

Uploading or transmitting (or attempting to do so) any material that is a passive or active means of collecting or transmitting information, including GIF graphics, 1×1 pixels, web errors, cookies and other similar tools called “spyware,” “passive collection mechanisms” or “PCM” among others.

Developing, using or distributing any type of automated systems, rogue utilities, parsers, scripts, systems/circuits to abuse the Site/Game/Application or offline readers among others, which can be used to improperly access the content of the Site and the Game/Application, including to gain any advantage in the game, such as incorrectly accruing tokens by exploiting vulnerabilities of one type or another.

Direct or indirect damage to us and/or the Site and the Game/Application. The existence and extent of the damage caused shall be determined and assessed by us in our sole discretion; use of the Site and the Game/Application in ways that are contrary to any applicable laws, rules and regulations.

Engaging in any activities on the Site and the Game/Application that directly or indirectly relate to terrorist financing, money laundering, organizing and conducting illegal gambling, among other things, and any activities that violate international laws or the laws of your country of residence and/or domicile.

Intentional use for your own or others' benefit of technical or technological errors, bugs, malfunctions and other defects that may occur on the Site and in the Game/Application. If any such factors are detected, the User should immediately report them to the SuperMole team.

Creation and use by one person of more than one account on the Site and in the Game/Application.

The above mentioned points regarding bans also apply to any actions made on the official social networks of the game.

PLEASE NOTE: IF YOU VIOLATE THE CURRENT TERMS, CONDITIONS AND RISKS, YOUR ACCOUNT MAY BE BLOCKED. AS A RESULT, YOU MAY LOSE VARIOUS FEATURES ON SUPERMOLE, INCLUDING ACCESS TO YOUR INTERNAL BALANCE, THE ABILITY TO RECEIVE TOKENS WITHIN THE GAME AND/OR OTHER FEATURES ON THE SITE AND IN THE GAME/APP. SUPERMOLE WILL NOT, UNDER ANY CIRCUMSTANCES, COMPENSATE USERS FOR ANY LOSSES AFTER SUCH BLOCKING. BASED ON THE ABOVE, BY ACCEPTING THE RULES OF THE PLATFORM AND THE APPLICABLE TERMS, CONDITIONS AND RISKS, YOU UNDERSTAND AND AGREE THAT IF YOU VIOLATE THE ESTABLISHED RULES, YOU MAY LOSE ALL YOUR CRYPTOCURRENCIES, TOKENS AND ANY OTHER ASSETS, AS WELL AS NUMEROUS OPPORTUNITIES WITHIN THE SUPERMOLE GAME (INCLUDING THE ABILITY TO RECEIVE TOKENS FOR THE GAME, WITHDRAW AND EXCHANGE THEM) WITHOUT THE RIGHT TO RECEIVE ANY FORM OF COMPENSATION. YOU FURTHER AGREE THAT ANY SUSPENSION OR TOTAL LOCKOUT OF YOUR ACCOUNT MAY BE EFFECTED WITHOUT PRIOR NOTICE TO YOU AND THAT WE WILL NOT BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY SUCH SUSPENSION OR LOCKOUT.

Operations with cryptocurrencies, tokens and other digital assets

The Site and the Game/Application may utilize third-party services in one way or another. If, when such opportunities are available, you decide to perform any transaction through the Site or Game/Application (by any means, including simply clicking on any link) using DEX, trading platforms, wallets or any other third-party services, including exchange and payment services, then any transaction you perform using the available methods must be carried out by you in accordance with the own terms and conditions of these services. SuperMole for its part only provides the functionality of transactions within the Application/Game/Site. Application Programming Interfaces (APIs) may be used in doing so. No third-party services, including but not limited to DEX, trading platforms, wallets, including payment services and any other services, are in any way controlled by us. However, SuperMole also reserves the right to use its own exchange and other services to enable all of the above-mentioned transactions. You confirm that you voluntarily agree to use DEX, trading platforms, wallets, any other services, including exchange and payment services, and you do so at your own risk. You confirm that under no circumstances will you make any claims against SuperMole in relation to any DEX, trading platforms, wallets and any other services, including payment and exchange services. We shall not be liable to Users or any third party for any claims or losses they may have as a result of any transactions through DEX, trading platforms, wallets and any other services, including payment and exchange services. To the maximum extent permitted by applicable law, you acknowledge and agree that we have no obligation to return or reimburse you for funds or any other assets, including game and digital assets (including any cryptocurrencies, tokens and other blockchain-based products), on the Site or the Game/Application in the event of any losses/losses due to incorrect or erroneous transactions or actions/transactions made by you for any reason whatsoever, including if they are in no way related to DEX, trading platforms, wallets or any services (including payment and exchange services), but relate only to the Site and the Game/Application. Any requests for reimbursement or compensation for financial or other losses/losses, monetary or otherwise, that a User may incur in connection with the use of the Site or the Game/App shall be accepted or rejected by us at our sole discretion. Circumstances that could potentially result in loss, loss or damage to the User are listed below, but are not limited to:

Warning of Risks in Using the Site and Game/Application

SuperMole does not assume any liability for any loss, damage or claim incurred by the User for any reason whatsoever, including without limitation the following:

Actions of the User, which resulted in the loss of the User's ability to use the Site and the Game/Application correctly and/or fully. This includes the loss of any information, including loss of access to the account on the Site and the Game/Application, etc. by the User.

Problems that cause incorrect operation of the Site and Game/Application or any affiliated sites, Software or Services. These include software corruption, access to unsafe cryptographic libraries, infection of the Site and the Game/Application or any affiliated sites, Software or Services with malicious code.

Technical problems on the User's side, resulting in the User himself/herself losing access to the Site and the Game/Application or any affiliated sites, Software or Services. For example, loss of credentials or any other data due to malfunction or complete failure of the device on which the User stored such data.

Problems, one way or another concerning the security of the User of the Site and the Game/Application, which occurred due to unauthorized access of third parties to the User's account, wallet and other confidential data.

Various events or situations that may directly affect the User's access to the Site/Game/Application, but are beyond the control of SuperMole. For example: stoppage or failure of the service provider, force majeure, hacker attacks on the Game/Application and/or the Site, the provider's network, etc., military actions, domestic and international sanctions, fraud by third parties or Users themselves, and other factors beyond SuperMole's control. This includes loss of access to third party services, including loss of access to the wallet mnemonic phrase or any other information or equipment.

SuperMole has no affiliation with or control over these web resources. We also do not comment on, nor are we responsible for, the content that appears on these web resources. You follow a link to a third-party resource from the Site or Game/Application solely at your own discretion and are solely responsible for any results of such a link, including negative consequences for yourself and your equipment (PC, tablet, smartphone, etc.). Warning about the risks of using cryptocurrencies, tokens of all kinds and other digital assets

By using the Site and the Game/Application, you wholeheartedly acknowledge that:

you have sufficient experience with cryptocurrencies, tokens of all kinds and other digital assets, as well as with blockchain-based infrastructures and services, and have a good understanding of their design, operation and interaction.

you fully understand and accept the risks associated with the storage, exchange and trading of cryptocurrencies, tokens of all kinds and any other gaming and digital assets.

Unless otherwise agreed, you will not rent, lend, sell, transfer, distribute or sublicense your account or our services, digital items or assets in any form. Unless otherwise agreed, you must not make our services available over a network where they may be used simultaneously on multiple devices.

you fully understand and agree that no in-game and/or digital asset (cryptocurrency, token or otherwise) used in SuperMole or outside of the game (e.g. on DEX) is guaranteed to generate any form of profit or income.

BY USING THE SITE AND THE GAME/APP, YOU FULLY UNDERSTAND THAT CRYPTOCURRENCIES, TOKENS OF ALL KINDS AND ANY OTHER GAME AND DIGITAL ASSETS HAVE EXTREMELY HIGH VOLATILITY - THEIR MARKET RATE CAN FLUCTUATE IN A WIDE RANGE IN DIFFERENT AND UNPREDICTABLE PERIODS OF TIME (BOTH WITHIN ONE DAY, ONE HOUR, ONE MINUTE AND OVER A LONG PERIOD OF TIME), AND AT ANY MOMENT THEIR MARKET RATE CAN FALL TO ZERO. THEY MAY ALSO DISAPPEAR COMPLETELY FROM THE GLOBAL ECOSYSTEM OR BE BANNED BY LEGISLATION AT ANY TIME. BASED ON THE ABOVE, THERE ARE HIGH RISKS OF LOSING ALL YOUR MONEY (OR OTHER ASSETS) SPENT BY YOU TO BUY OR RECEIVE CRYPTOCURRENCIES, TOKENS OF ALL KINDS AND ANY OTHER GAMING AND DIGITAL ASSETS. Intellectual property rights

You understand and agree that the Site and the Game/Application are the property of SuperMole or its licensors. Subject to your compliance with the applicable Terms, Conditions and risks, SuperMole grants you a limited right to access and/or use the Site and the Game/Application in accordance with the purposes for which they were created. However, the owner of all rights in the software, graphics, textual content, design elements and other components of the Site and Game/Application that are unique is solely SuperMole or our licensors. Nothing in the applicable Terms, Conditions and Risks grants you any ownership rights in any unique constituent elements of the Site and the Game/Application. You acknowledge and agree that SuperMole retains all ownership rights and interests in all copyrights, trademarks, trade secrets, patents and any other proprietary rights in the Site and Game/Application, software and application programming interfaces (API), and all unique content present on the Site and Game/Application. You acknowledge and agree that our trademarks, service marks, logos and graphics are registered (or in the process of registration) trademarks or trademarks of SuperMole. You are prohibited from creating fan art (tokenized or physical), merchandise, or any other content related to the Site and the Game/App and its affiliated sites and projects for commercial use. If you plan to create fan art for your personal use (not for commercial purposes), any products you create will be required to be labeled “SuperMole Fan Art” and link to the Site or SuperMole Game/App. We reserve the sole right to determine whether a product is fan art/product or not.

Taxation principles

You are solely responsible for the payment of any applicable taxes (if any) in respect of your activities on the Site and in the Game/Application. It is also your sole responsibility to file the necessary reporting documentation (if any) with the tax authorities. For its part, SuperMole does not provide Users with any services for the formation of reporting documentation and does not control whether they comply with the tax laws applicable to them. At the same time, we strongly recommend all Users to comply with the requirements of tax legislation and pay the necessary taxes within the established deadlines.

Collaboration on advertising

SuperMole may authorize third parties to place advertisements and other information in certain locations on the Site and the Game/Application - including, but not limited to, banners, sidebars and pop-ups. Please note that the advertiser is solely responsible for the content of the advertisements it places on the Site or in the Game/App, as well as for any services it may provide on the Site or in the Game/App, or products it may market through its advertisements. In turn, we are not responsible for the content of the advertisements. In addition, before contacting us, the advertiser should obtain all necessary authorizations to advertise his product. The advertiser warrants that he will only offer us advertising if he explicitly possesses all rights and competences to advertise on the Website or in the Game/Application, including but not limited to intellectual property rights, advertising rights and contractual rights. For its part, SuperMole only provides the opportunity to place such advertisements in certain locations of the Site and the Game/Application and has no other interaction with advertisers.

Arbitrage

If any disputes arise regarding the Site, the Game, the Application, the Terms, Conditions, provisions and risks, the disputing parties should resolve such issues within a 7-day period from the date of their occurrence. The disputing parties confirm that they are willing to negotiate constructively and, as a result, reach an acceptable resolution for each party. If no agreement on the subject matter of the dispute is reached after the 7-day period, the dispute may be referred to an arbitral tribunal, which shall render a final decision, based on the then current Rules of Arbitration of the International Chamber of Commerce (ICC) (the “Rules”) as amended herein. The seat of the arbitral tribunal shall be Geneva, Switzerland. An application for arbitration shall be made and sent under the Rules or the Terms, Conditions and Risks with notice. The arbitral tribunal shall sit and decide the dispute in English. Three arbitrators shall be present at the meeting. If there are two parties to the dispute, each party shall appoint one arbitrator on its own behalf and the third arbitrator shall be appointed by the ICC Court in accordance with the provisions of the Rules. If there are more than two parties to the arbitration, the arbitrators shall be appointed in accordance with article 10 of the Rules. Upon application by any party to the arbitration dispute, any arbitrator not appointed within the prescribed period of time shall be appointed by the ICC in accordance with the provisions of the Rules. The award rendered by the arbitral tribunal shall be final and each party shall comply with it. However, no party to the arbitration dispute shall, after the award has been made, be entitled to apply to the English courts, pursuant to section 45 of the Arbitration Act 1996, or appeal on any question of law, pursuant to section 69 of the Arbitration Act 1996. In view of this, the award made by the arbitrators shall be the sole and exclusive remedy between the parties to the arbitration dispute in respect of any claim, counterclaim, issue or account submitted to the arbitral tribunal. Any arbitration dispute may be pursued before any judicial authority having jurisdiction. The parties agree that the ICC Court and/or the arbitral tribunal may, on application by any party to the arbitration, combine or consolidate two or more arbitration disputes arising out of or in connection with this agreement. This agreement shall be governed by English law without giving effect to conflict of laws rules.
